Is it mandatory to clock in at work? What the law says
Since 12 May 2019, Spanish companies are required to implement a working hours recording system for all their employees, both part-time and full-time. This measure was introduced through an amendment to Article 34 of the Workers’ Statute , supplemented by Article 10 of Royal Decree-Law 8/2019 .
The law requires companies to accurately record the entry and exit times of their employees. Although the law does not dictate a specific method for carrying out this record, it is mandatory that the data be kept for at least four years, as it must be accessible for possible inspections by the INSST , the Labor Inspectorate and the workers themselves.
Failure to comply with these regulations can result in significant financial penalties for companies, with fines of up to €6,250 for each worker not properly registered.
